Purpose of the Position

Presiding Judge Jeffrey T. Bergin announces that a Merit Selection Committee for the Superior Court is accepting applications for the upcoming Hearing Officer vacancy due to the retirement of Hon. Lee Ann Roads. This position will assist with civil, criminal, and family law cases.

The Hearing Officer will be responsible for professional work as a judicial officer involved in interpreting and applying local and state laws while conducting court proceedings with primary attention on considering variety of family law, civil and criminal matters within the jurisdiction of the Superior Court. The Hearing Officer will perform such other duties as are assigned by the Presiding Judge of the Superior Court and may also be appointed as a Judge Pro Tempore without additional compensation. Hearing Officers serve at the pleasure of the Presiding Judge and report to the Associate Presiding Judge. The current annual salary is $115,290 (Hearing Officers are to be paid at seventy (70) percent of the statutory salary of a Superior Court Judge).


Essential Functions

Duties may include, but are not limited to the following:
  • Receives evidence, makes findings and enters orders of protections and injunctions against harassment.
  • May conduct hearings and related proceedings in family law, criminal, or civil matters, on an ad hoc basis.
  • Hears testimony, rules on motions and relevancy of evidence; analyzes evidence and data presented in court and applies existing law in the rendering of fair and equitable judgments.
  • Uses considerable initiative, independent judgment and objectivity when hearing and evaluating evidence presented, questioning witnesses, and making decisions.
  • Applies law and precedent to facts and rules; imposes fines or sanctions and reviews complaints alleging violations.
  • May conduct civil matters which include the issuance of default judgments, and initiates action to collect ordered, but unpaid, fines on an ad hoc basis.
  • Issues subpoenas, administers oaths, and instructs parties as to their rights as needed
  • Completes and signs various legal forms, including but not limited to fee waiver and deferral applications.
  • May assist in the development of procedures and methods of operation.

Minimum Qualifications

A Hearing Officer of the superior court shall have A Juris Doctorate from an accredited law school; and be at least 30 years of age, of good moral character, admitted to the practice of law in this state for not less than five years preceding the appointment, a resident of the state for not less than five years preceding the appointment, and a member in good standing with the State Bar of Arizona.

SPECIAL NOTICE: The person occupying this position shall not practice law in Arizona’s Superior Courts, Justice Courts or Municipal Courts, and will be subject to provisions of the code of judicial conduct pursuant to Supreme Court Rule 81.

EORP
(ARS §38-801) Elected official who has money on account in EORP or appointed, elected, or hired on or before 12/31/2013 is required to remain in EORP.

ASRS
Official appointed, elected, or hired on or after 1/1/14 and does not have money on account with EORP but has money on account with ASRS must return to ASRS membership.

EODCRS
Official elected, appointed, or hired on or after 1/1/2014 and does not have money on account with EORP, does not have money on account with ASRS or does not timely opt out of the EODCRS to return to ASRS, if applicable, will automatically be enrolled in EODCRS.
